Fublic Works Department, Hongkong, 20th. July, 1903.

In reply to your letter of the 9th. instant,

I have the honour to say that I am unable to modify the require- ments of my letter to you of the 27th. ultiro in respect of the construction of the Tramway. I desire to point out that the origi- nal drawing.No. 1925, referred to by you in your letter under reply, is the cross section required by section 13 of Ordinance 10 of 1902 to be laid before me for approval before your Company could legally commence the construction of your Tramway; and that such cross section was laid before me, and, subject to modifica- tions accepted by your Company, was approved by me under the authority of the Ordinance referred to. I desire further to point out that but for your Company's acceptance of the modifications required by me I should not have approved the cross section so laid before re, with the consequence to your Company that no work could have been commenced. In this regard your attention is directed to section 13 of the Tramway Ordinance No. 10 of 1902.

I desire to add that in the event of your Company failing to carry out the construction of the Tramway, in accordance with the cross-section No. 1925. as approved by me, the provisions of the Tramway Ordinance will be inforced.

I desire further to say, that, if you are not prepared to comply with my requirements, your proper course would seem to be to take the opinion of the Supreme Court by a special case to be stated under Section 24 of the Tramway Ordinance No. 1C of 1902.
